Definitions
THE COMPANY – Joint Stock Company “UTair Aviation”.
AIRWAY BILL - a document made for and on behalf of a consigner which verifies the contract between the consigner and a carrier for transportation of goods on the carrier’s route.
AIR TRANSPORT COMPANY (AIRLINE, AIRPORT) – company established on the territory of the Russian Federation and according to the laws and regulations of the Russian Federation (RF) regardless of forms of ownership and with the purpose of air transportation (of passengers, baggage, mail and cargo consignments), air operations and services on a commercial basis.
AVIATION SECURITY – a state of aviation security from an unauthorized interference with the aviation activities.
AGENT – a legal entity or an individual which are authorized to act on behalf of the Carrier in accordance with an agreement in writing or Power of Attorney.
ACT OF UNAUTHORIZED INTERFERENCE – illegal and violent acts or a threat of such acts on the part of a person (group of persons) with respect to an aircraft, passengers, crew members, airport facilities and ground staff, which endanger flight safety, lives and health of people.
PROPERTY IRREGULARITY REPORT (PIR) – a document made by a Carrier in the presence of a Passenger (Consignee) immediately after discovery of damage to baggage.
EXAMINATION REPORT – a document made by an official state controlling authorities in which experts register the main data regarding the nature, meaning and type of damage, and the actual amount of damage.
AIR TERMINAL (TERMINAL) – complex of buildings which is intended for performing services to departing and arriving passengers.
AIRFIELD – a land site specially equipped for the take-off, landing, taxiing, parking and handling of aircraft.
INTERNATIONAL AIRPORT – airport which performs air transportation services and ensures customs, border and quarantine control.
AIRPORT (POINT) OF DESTINATION – airport (point) that a passenger, baggage or cargo consignment must be delivered at according to air transportation services agreement.
TRANSFER AIRPORT (POINT) – an intermediate airport (point) which is indicated in a ticket and at which a Passenger according to air transportation services agreement transfers from one flight to another flight in order to continue the route of transportation.
STOPOVER AIRPORT (POINT) – an intermediate airport (point) on the route, at which a Passenger discontinues the flight for 24 hours or more according to air transportation services agreement.
AIRPORT (POINT) OF DEPARTURE – airport (point) at which transportation services begin according to air transportation services agreement.
HUB AIRPORT – airport with big amount of departing and arriving flights and great percentage of connection flights, where the schedule of departing and arriving flights is coordinated.
BAGGAGE – belongings of a Passenger which are carried according to air transportation services agreement.
CHECKED-IN BAGGAGE – baggage of a Passenger which is accepted by a Carrier for transportation within Carrier’s responsibility and for which the Carrier issued a baggage receipt and a baggage tag.
BAGGAGE TAG – a document issued by a Carrier solely for identification of checked-in baggage.
BAGGAGE SHEET – a document which certifies acceptance and delivery of checked-in baggage to those persons who are responsible for its safety.
OVER DIMENSIONED BAGGAGE – baggage which exceeds the defined dimensions.
DAMAGED BAGGAGE – baggage which was damaged during air transportation or in the course of its handling by a Carrier.
UNACCOMPANIED BAGGAGE – baggage which is carried separately from a Passenger.
PAID (EXCESS) BAGGAGE – part of the baggage weight which exceeds the norms of free baggage allowance defined by a Carrier, or requires a mandatory payment regardless of the defined norms.
FLIGHT SAFETY – a feature of an air transport system which ensures performing air transportation services without any life and health risks.
TICKET (PASSENGER TICKET AND BAGGAGE RECEIPT) – a transportation document in hard copy or in electronic format which certifies and agreement with a Carrier and the conditions of air transportation of a Passenger and his/her baggage.
BOOKING – preallotment of a seat for transportation of a Passenger on an aircraft, as well as defining the volume and tonnage for transportation of baggage and cargo.
DOMESTIC AIR TRANSPOTATION – air transportation with the point of departure, point of destination and all points of the route are located in Russia.
REFUND OF AMOUNTS – partial or full refund of the cost of transportation and services to a Passenger, which he/she earlier paid for but which were not used by him/her.
AIR TRANSPOTATION – transportation of passengers, baggage, cargo and mail consignments on aircraft based on and according to air transportation services agreement.
CARGO – assets (goods) which is transported or accepted for transportation on aircraft, except for baggage and mail, and which are indicated in an airway bill.
LIGHT WEIGHT (BULKY) CARGO – cargo, if the unit volume exceeds 0,006 cm (6000 cc) per 1 gross kg.
UNCLAIMED CARGO - cargo which was not received within 30 days of the day of a consignee duly documented notification.
SPECIAL CARGO - cargo which due to its value or nature requires special attention and handling during its acceptance, storage, transportation, loading and unloading.
TRANSFER CARGO - cargo which according to an airway bill is delivered at transfer airport (point) with one flight, and transported further with another flight of this or another carrier.
HEAVY CARGO - cargo, if one place of such cargo exceeds 80 kg.
MISSING CARGO - cargo which was specified in a cargo manifest of a flight and which did not arrive with this flight.
VALUABLE CARGO - cargo containing gold in coins, bars or powder, platinum, silver and other precious metals, precious and semiprecious stones including industrial diamonds, foreign currency in notes or coins, shares, bonds, coupons, uncancelled stamps and other securities, as well as jewelry transported subject to special conditions set by the Carrier.
CARGO CONSIGNMENT - one or several pieces of cargo which were accepted by the Carrier from one consigner at the same time and which are forwarded to one and the same Consignee under one and the same airway bill.
SHIPMENT - cargo which is accepted for transportation from one consigner and forwarded to one or several consignees under several airway bills.
CARGO MANIFEST - transportation document specifying cargo consignments on a given route. Cargo manifest is executed by a responsible Carrier or its handling agent.
CONSIGNER - an individual or an entity having a transportation agreement with a Carrier, and the name of such an individual or an entity is specified in an airway bill as a party to this agreement.
CONSIGNEE - an individual or an entity being the addressees of cargo specified in an airway bill.
AIRCRAFT CHARTER AGREEMENT – an agreement according to which one party (carrier) undertakes to provide all aircraft capacity or part of such capacity to another party (charterer).
PREFLIGHT CHECK – check of the hand baggage and passenger screening (personal search), check of aircraft, cargo, AC crews, service staff, and aircraft supplies with the purpose of detecting substances and objects which are not allowed for transportation (explosives, flammable, radioactive, poisonous substances, weapons, ammunition, narcotic drugs etc.) by aircraft subject to provisions of aviation safety.
TRANSIT AREA – area in an international airport dedicated for transit (transfer) passengers controlled by competent state authorities.
INTERNATIONAL TRAVEL GUIDELINES – guidelines containing government requirements regarding departure/entry (transfer, transit, overstop) from/to a country during air transportation.
PAID BAGGAGE RECEIPT – a document verifying the payment for excess baggage specified for a corresponding class of service and indicated in a corresponding flight coupon of a flight ticket, or items the transportation of which is subject to mandatory payment.
COMPETENT AUTHORITIES – authorities which perform imperative and administrative functions based on the powers granted by the state.
COMMERCIAL ACT – a document made by a Carrier in the presence of a Consignee in the event of detection of damage to baggage or cargo during transportation.
CONVENTION (WARSAW CONVENTION FOR THE UNIFICATION OF CERTAIN RULES RELATING TO INTERNATIONAL CARRIAGE BY AIR, 1929) – an interstate agreement which regulates international air transportation services. The Convention specifies the contents of transportation documents and procedure of their application. The Convention also defines the Carrier’s responsibility for personal damage to passengers, for destruction, loss or damage to baggage and cargo, and losses due to delay during air transportation.
THE HAGUE PROTOCOL (Protocol to amend the Convention for the unification of certain rules relating to international carriage by air, 1955) – a document to amend Warsaw Convention. The amendments were introduced into wordings of certain articles and articles regarding the limits of Carrier’s responsibility before passengers. The Protocol specifies the time for submission of claims.
THE CONVENTION ON INTERNATIONAL CIVIL AVIATION (THE CHICAGO CONVENTION, 1944) – interstate agreement, which recognized the statement that “every state has complete and exclusive sovereignty over airspace above its territory” and which set forth “certain principles and arrangements in order that international civil aviation may be developed in a safe and orderly manner and that international air transport services may be established on the basis of equality of opportunity and operated soundly and economically”. The Convention established the International Civil Aviation Organization (ICAO).
CONVENTION ON DAMAGE CAUSED BY FOREIGN AIRCRAFT TO THIRD PARTIES ON THE SURFACE (ROME CONVENTION, 1952) - an interstate agreement which set the limits of Carrier’s responsibility before third parties.
CONVENTION FOR THE SUPPRESSION OF UNLAWFUL ACTS AGAINST THE SAFETY OF CIVIL AVIATION (MONTREAL CONVENTION, 1971) – an interstate agreement on measures to suppress the unlawful acts against civil aviation activities and measures taken by the government.
CONTAINER – transportation equipment for multiple use on one or several types of transport, intended for transportation and temporary storage of cargo, with devices ensuring its mechanical installation and removal from transportation means.
LICENSE - a permission issued by a responsible state authority – Federal Air Transport Agency of the Russian Federation – to an entity or to an entrepreneur for commercial transportation (for value or on hire) of passengers and cargo, and for performing airport and other activities related to AC, passengers and cargo services at airports, as well as air operations for entities and common public.
MARKING – texts, symbols and drawings on packing and/or products.
INTERNATIONAL AIR TRANSPORT ASSOCIATION (IATA) – a nongovernmental international agency which develops recommendations on the level, structure and procedure of rates application, and unified transportation conditions, including standards of passenger services.
INTERNATIONAL CIVIL AVIATION ORGANIZATION (ICAO) – an interstate international organization (UN special body) which regulates the issues of civil aviation activities including the issues of airways usage, flight safety etc., and which develops the “Standards and recommended practices of civil aviation activities”.
INTERNATIONAL VETERINARY HEALTH CERTIFICATE – a document issued by a border control veterinary station at the airport instead of a veterinary statement (Form 1, containing information regarding vaccination, state of animal’s health and satisfactory sanitary and epidemiological situation in the region of residence) and permit of a Kennel Club (Feline club) for transportation of the animal.
INTERNATIONAL TRANSPOTATION OF PASSENGERS AND BAGGAGE – transportation during which airport (point) of departure and airport (point) of destination, regardless of any stops during the journey, are located either on the territory of two states, or on the territory of one state, if there is a stop on the territory of another state.
INTERNATIONAL TRANSPORTATION REGULATED BY A WARSAW CONVENTION - transportation during which point of departure and point of destination, regardless of any stops during transportation, are located either on the territory of two states which signed the Convention, or on the territory of one state, which signed the Convention, if there is a stop on the territory of another state which may not be a member of this Convention.
INTERNATIONAL TRANSPORTATION REGULATED BY A WARSAW CONVENTION, CHANGED BY THE HAGUE PROTOCOL – air transportation during which point of departure and point of destination, regardless of any stops during transportation, are located either on the territory of two states which signed the Hague Protocol, or on the territory of one state, which signed the Hague Protocol, if there is a stop on the territory of another state which may not be a member of the Hague Protocol.
Air transportation without such a stopover between two points located on the territory of one and the same country can not be considered international in the context of Warsaw Convention.
TRANSPORTATION IRREGULARITY – any irregularities of the approved air transport operations (misdirection of baggage, cargo, underweight or quantity deficiency, damage, loss or detachment of documents, improper execution of transportation documents) which resulted or could result in harmful consequences.
MISCELLANEOUS CHARGES ORDER (MCO) – a payment document issued to a Passenger by a Carrier or his agent, verifying the payment of ticket, paid baggage receipt or other services related to performance or change of the conditions of transportation.
OVERSTOP – an intermediate point of the route agreed with a Carrier and considered in a tariff, in which a Passenger temporarily discontinues the transportation.
CARRIER’S RESPONSIBILITY – responsibility of a Carrier to compensate for the damage caused during air transportation of passengers, baggage and cargo.
PASSENGER – a person who is carried or must be carried by an aircraft according to air transportation agreement.
ILLEGAL PASSENGER – a person who arrived at a country illegally and who is afterwards ordered to leave the territory of such a country.
TRANSIT PASSENGER – a person who arrived at an intermediate airport according to air transportation agreement and who is further carried with the same flight.
TRANSFER PASSENGER – a person who is delivered to a transfer point with one flight, and further carried with another flight of the same or another carrier.
PASSENGER COUPON – a part of a transportation or payment document verifying the transportation agreement or other services performed by a Carrier.
CARRIER - an airline which issues transportation documents, performs or undertakes to perform air transportation services, and provides or undertakes to provide services related to such transportation according to transportation or payment documents, issued by an airline or another carrier which is valid on the routes of the airline.
CARRIER- PARTNER – a carrier with which there is an additional agreement (Agreement on mutual recognition of transportation documents – Interline Agreement, or an Agreement on joint operation of air lines – Code Sharing Agreement).
ENDORSEMENT – a written consent of a Carrier who issues transportation or payment documents, or Carrier, specified in a corresponding flight coupon of a transportation document, or exchange coupon of a payment document for transportation by another Carrier or exchange of initially issued transportation or payment document.
TIME OF BAGGAGE AIR TRANSPOTATION – period of time starting from the moment of acceptance of baggage for transportation till its delivery to a passenger or its delivery for safekeeping.
TIME OF PASSENGER AIR TRANSPOTATION - period of time starting from the moment when a Passenger enters an apron of the airport or air bridge before boarding an aircraft till the moment when the Passenger leaves the air bridge or apron under supervision of authorized staff of a Carrier.
APRON – a part of a civil airfield intended for arranging aircraft in order to perform boarding and disembarking of passengers, loading and unloading of baggage, cargo and mail, and render other types of services.
FLIGHT COUPON – a part of a ticket which gives a right to a Passenger (provided that he/she has a passenger coupon) for transportation between the points specified in the coupon.
CLAIM – a written reference of a passenger, cargo consigner, consignee or an authorized person regarding failure to perform on improper performance of obligations under passenger, baggage or cargo air transportation agreement, or other obligations related to entry into, execution or termination of the mentioned agreement and containing claims on the Company.
PROFILING – a procedure of monitoring and passengers survey aimed at detecting persons threatening flight safety.
FLIGHT - scheduled or unscheduled aircraft flight between the initial and destination points.
SCHEDULED FLIGHT – aircraft flight performed en route according to the approved schedule.
ADDITIONAL FLIGHT - aircraft flight performed additionally to the schedule and on the same route as the scheduled flights.
CHARTER FLIGHT – aircraft flight performed in accordance with aircraft charter agreement.
HAND BAGGAGE – Passenger’s baggage being within Passenger’s responsibility during air transportation in aircraft cabin upon Carrier’s consent, and certified by a “Cabin” tag.
CHARGE – an approved amount in excess to the rate, charged by Carrier, its agent or other competent authorities.
DISCOUNT – a reduction of a published rate, set by a Carrier according to IATA recommendations.
CUSTOMS CONTROL DURING INTERNATIONAL AIR TRANSPORTATION – control over the movement of aircraft and transported cargo across the state border, including transfer of registered and cabin baggage of individuals traveling on such aircraft, and transfer of foreign currency and currency valuables, intended for protection of state economy and ensuring the performance of the tasks of foreign economic policy.
TARIFF - a charge for air transportation of a Passenger, excess baggage (in weight or quantity), cargo or mail consignments.
STANDARD TARIFF – a tariff of a corresponding class of service applied without any restrictions during one year (except for seasonal rates which are valid during the transportation season).
PUBLISHED TARIFF – a tariff registered by state authorities in accordance with a corresponding procedure and published in a tariff book.
THROUGH FARE – a tariff which is applied in the event of payment for transportation on the entire route.
SPECIAL TARIFF – a tariff which is different from a standard one, and which is set with consideration of discounts.
CHARTER TRANSPORTATION – unscheduled air transportation performed in accordance with a charter agreement.
