Part 6. Administrative issuies

6.1.1 Passport, customs and other regulations established in accordance with the laws and regulations of the Russian Federation can be applied to passengers arriving at or departing from the Russian Federation or flying through the Russian Federation, as well as baggage and cargo imported to or exported from the Russian Federation. 

6.1.2 A passenger, cargo consigner (consignee) shall comply with the laws, regulations and other regulatory documents of competent state authorities, from which or through which air transportation of a passenger, baggage and cargo related to fulfillment of aviation safety requirements, customs, quarantine, immigration, veterinary, phytosanitary, currency and other types of control,  is performed.  

6.1.2 When passing customs, quarantine, veterinary, phytosanitary and other types of control, a passenger and cargo consigner (consignee) shall comply with the requirements of corresponding state controlling authorities. 

6.1.3 At border checkpoints a passenger, cargo consigner (consignee) shall show entry, departure, medical and other documents, specified by competent state authorities of the countries, from (to) which or through which air transportation of a passenger, baggage and cargo is performed.  

6.1.4 Regulation of relations between state controlling authorities and a passenger, cargo consigner (consignee) arising out of international air transportation of a passenger, baggage and cargo, refers only to jurisdiction of a passenger, cargo consigner (consignee) himself and not of the Company. 

6.1.5 The Company shall not be responsible for the availability, reliability and correctness of documents presented in the course of air transportation of a passenger, baggage and cargo, which are issued by competent state authorities.  

6.1.6 The Company shall have the right to deny air transportation of a passenger, baggage and cargo, if the documents for such transportation are not fully provided by a passenger, cargo consigner (consignee), or if they are incorrectly issued. The Company shall not be responsible before a passenger, cargo consigner (consignee) for the expenses related to failure to comply with the requirements of state controlling authorities for air transportation of passengers, baggage and cargo. 

6.1.7 The Company shall not be responsible for the late arrival of passengers for a flight due to passing customs, quarantine, veterinary, phytosanitary and other types of control.

6.2.1 If competent state authorities oblige the Company to deliver a passenger who was denied in entry to a country of destination, transfer or transit, back to airport of departure or another airport, this passenger or his/her company shall reimburse for all the expenses incurred by the Company, related to this air transportation.  

A passenger shall also reimburse for other expenses (fines, guarantee payments) incurred by the Company and related to denial of entry of this passenger to a country of destination, transfer or transit. 

6.2.2 The Company shall have the right to use the amounts at its disposal which were paid by a passenger for unperformed transportation, or another amount provided to the Company, as a compensation of all expenses related to deportation of this passenger according to the requirement of state controlling authorities. 

6.2.3 The Company shall have the right to demand for a compensation, and to pay for a corresponding tariff with any amounts at its disposal, provided by a passenger or passenger’s company for an unused transportation, or with any other amounts provided by a passenger or a passenger’s company which paid for a passenger ticket.

6.3.1 In order to ensure safety of aircraft passengers and crew members, an aircraft, crew members, passengers, baggage including item that passengers have with them, mail and cargo are subject to preflight inspection. 

6.3.2 During the procedure of customs control, a Passenger shall carry out the requirements of state customs authorities, be present in the course of preflight inspection of his/her checked and hand baggage. 

Preflight inspection of checked and hand baggage is performed only in the presence of a Passenger. In urgent cases, in the event there is a suspicion that the baggage contains some dangerous goods and items which are not allowed for transportation by civil aircraft, preflight inspection can be performed without the Passenger. 

6.3.3 Personal inspection of a Passenger can be performed to the extent necessary for detection of weapons, ammunition, dangerous goods and items which are not allowed for transportation by aircraft. Personal inspection of passengers is mandatory in the following cases: 

  • information about possible seizure (hijacking) of an AC which is being prepared for a certain flight or performing the flight in a certain direction;
  • information that a passenger has with him weapons, ammunition, explosives and other dangerous goods which are not allowed for transportation;
  • detection of weapons, ammunition, explosive devices, explosives and  other dangerous goods which are not allowed for transportation by air;
  • revealing by means of personal observation or in the course of profiling procedure performed by aviation security service of the signs which testify of criminal intentions of a passenger, or possible presence of weapons, ammunition, dangerous goods and items, which are not allowed for transportation by air. 

6.3.4 If a Passenger refuses to pass an inspection, the Company shall have the right to deny transportation, and such refusal shall be considered to be a voluntary refusal from transportation. The Company shall not be in any way responsible before a Passenger due to refusal from transportation, except for responsibility to refund the amount paid for unused transportation. 

6.3.5 A Passenger shall carry out the requirements of the Federal Security Service, Internal Affairs authorities, security services of an airport and the Company, and other authorities and services. 

6.3.6 Substances and item detected during a preflight inspection of passengers of international flights, which can be used as means of attack against the crew members and passengers, but which are allowed for transportation according to the rules of international air services and customs authorities, shall be withdrawn for the period of the flight and carried in AC baggage compartments. PIC shall be informed of such withdrawal. 

Withdrawn items shall be handed over to their owners after arrival at airport of destination outside the airport area. 

6.3.7 Weapons, ammunition, explosives and other dangerous substances and items, which are not allowed for transportation across the state border of the Russian Federation, detected by the aviation security service on international flights, and persons who tried to carry such items, are handed over to law-enforcement and customs authorities.
